Notice of Privacy Practices

Effective date: September 22, 2026

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This Notice of Privacy Practices applies to Welgen Global Enterprises, LLC, doing business as Welgen One, its covered healthcare components, healthcare professionals, workforce members, contractors, and locations that are permitted to participate in this notice.

Welgen One is required by law to protect the privacy and security of your protected health information. This notice explains your rights, our responsibilities, and the ways we may use and disclose your health information.

Your Rights

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities.

Obtain an Electronic or Paper Copy of Your Medical Record

You may ask to see or receive an electronic or paper copy of your medical record and other health information we maintain about you. Contact us to learn how to make this request.

We will usually provide a copy or summary of your health information within 30 days of receiving your request. We may charge a reasonable, cost-based fee as permitted by law.

Ask Us to Correct Your Medical Record

You may ask us to correct health information that you believe is inaccurate or incomplete. Contact us to learn how to submit an amendment request.

We may deny your request in certain circumstances. If we deny the request, we will explain the reason in writing, generally within 60 days.

Request Confidential Communications

You may ask us to contact you in a particular way, such as only at your mobile telephone number, or to send mail to a different address.

We will accommodate reasonable requests. We may ask you to submit the request in writing and provide the alternative contact information we should use.

Ask Us to Limit What We Use or Disclose

You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations. We are generally not required to agree to this request. We may deny a request if it could affect your care or our ability to provide services.

If we agree to a restriction, we will comply with it except when the information is needed to provide emergency treatment or when disclosure is otherwise required by law.

If you pay for a healthcare service or item entirely out of pocket, you may ask us not to disclose information about that service or item to your health plan for payment or healthcare operations. We will agree unless a law requires us to disclose the information.

Receive an Accounting of Disclosures

You may request a list, called an accounting of disclosures, showing certain disclosures of your health information made during the six years before the date of your request.

The accounting will not include every disclosure. For example, it generally will not include disclosures made for treatment, payment, healthcare operations, or disclosures you specifically authorized.

We will provide one accounting during any 12-month period without charge. We may charge a reasonable, cost-based fee for additional accountings requested during the same 12-month period. We will notify you of the cost before processing an additional request.

Receive a Copy of This Notice

You may request a paper copy of this notice at any time, even if you previously agreed to receive it electronically. We will provide a paper copy promptly.

Choose Someone to Act for You

If you have given someone medical power of attorney, appointed a healthcare agent, or have a legal guardian or other legally authorized personal representative, that person may exercise your rights and make choices concerning your health information.

We will verify that the person has the appropriate authority before taking action.

File a Privacy Complaint

You may complain if you believe Welgen One has violated your privacy rights. Contact our Privacy Officer using the information at the end of this notice.

You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by:

  • Visiting www.hhs.gov/hipaa/filing-a-complaint
  • Calling 1-877-696-6775
  • Writing to the U.S. Department of Health and Human Services, 200 Independence Avenue SW, Washington, DC 20201

Welgen One will not retaliate against you for filing a good-faith complaint.

Your Choices

For certain health information, you may tell us your preferences about what we disclose. If you have a clear preference in one of the situations described below, tell us what you want us to do. We will follow your instructions when required by law.

Family Members, Friends, and Others Involved in Your Care

You may tell us whether we may disclose relevant health information to a family member, close friend, caregiver, or another person involved in your care or payment for your care.

If you cannot tell us your preference, such as when you are unconscious or otherwise unavailable, we may disclose information if we reasonably believe doing so is in your best interest. We may also disclose information when necessary to reduce a serious and imminent threat to health or safety.

Disaster Relief

We may disclose limited information to an authorized disaster-relief organization so that your family or others responsible for your care can be notified about your location, condition, or death.

You may tell us not to make this disclosure. If you cannot communicate your preference, we may disclose information when we believe doing so is in your best interest or necessary to respond to the emergency.

Uses Requiring Written Authorization

We will generally obtain your written authorization before:

  • Using or disclosing your health information for marketing when HIPAA requires authorization
  • Selling your health information
  • Disclosing most psychotherapy notes, if Welgen One maintains psychotherapy notes about you
  • Using or disclosing your health information for another purpose not described in this notice and not otherwise permitted or required by law

If you give us written authorization, you may revoke it at any time by notifying us in writing. Revocation will not affect actions we already took in reliance on your authorization.

Fundraising

Welgen One may contact you about fundraising activities when permitted by law. You may tell us not to contact you again for fundraising purposes.

If we maintain substance-use-disorder patient records protected by 42 CFR Part 2 and propose using Part 2 information for fundraising, we will provide clear and conspicuous notice in advance and an opportunity to opt out of receiving those communications.

How We Typically Use and Disclose Your Health Information

Treatment

We may use your health information and disclose it to physicians, nurses, laboratories, pharmacies, healthcare facilities, care coordinators, and other professionals who are treating you or assisting with your care.

Example: A healthcare professional treating you may ask another professional about your medical history or test results.

Healthcare Operations

We may use and disclose your health information to operate our organization, coordinate services, improve the quality of care, train personnel, evaluate performance, conduct compliance activities, manage risk, and contact you when necessary.

Example: We may review health information to evaluate the quality and effectiveness of our services.

Payment

We may use and disclose your health information to bill for healthcare services and obtain payment from you, an insurer, employer health program, benefits administrator, or another responsible party.

Example: We may provide information about a service to your health insurance plan so it can determine coverage and process payment.

Appointment Reminders and Service Communications

We may use your contact information to provide appointment reminders, registration instructions, follow-up communications, care coordination messages, test notifications, or information about treatment alternatives and health-related services that may be relevant to you.

You may ask us to use a particular communication method or contact you at a different address or telephone number.

Business Associates

We may disclose health information to vendors and contractors that perform services involving protected health information on our behalf. These organizations are called business associates.

When required by HIPAA, business associates must enter into written agreements requiring them to appropriately safeguard protected health information.

Other Permitted or Required Uses and Disclosures

We may use or disclose health information in other ways that contribute to public health, safety, government oversight, and the administration of justice. We must satisfy applicable legal requirements before making these disclosures.

Public Health and Safety

We may disclose health information for legally authorized public health and safety activities, including:

  • Preventing or controlling disease
  • Reporting certain diseases, injuries, births, or deaths
  • Reporting adverse reactions to medications or medical products
  • Assisting with product recalls
  • Reporting suspected abuse, neglect, or domestic violence
  • Preventing or reducing a serious threat to a person’s health or safety

Health Oversight

We may disclose health information to health oversight agencies for activities authorized by law, including audits, inspections, investigations, accreditation, licensing, and disciplinary proceedings.

Research

We may use or disclose health information for research when the research has been approved through a process that considers patient privacy, when the information has been appropriately de-identified, or when another legal permission applies.

Compliance With the Law

We will disclose health information when federal or state law requires us to do so. This may include disclosures to the U.S. Department of Health and Human Services when it is reviewing our compliance with federal privacy requirements.

Organ and Tissue Donation

We may disclose health information to organ procurement organizations and similar entities for organ, eye, or tissue donation and transplantation purposes.

Medical Examiners and Funeral Directors

We may disclose health information to a coroner, medical examiner, or funeral director when an individual dies and the disclosure is permitted by law.

Workers’ Compensation

We may disclose health information as authorized by and to the extent necessary to comply with workers’ compensation laws and similar programs.

Law Enforcement and Government Functions

We may use or disclose health information for certain legally authorized law-enforcement purposes, correctional activities, military and veterans’ activities, national security, intelligence activities, protective services, and other special government functions.

These disclosures are limited by HIPAA and other applicable federal and state laws.

Lawsuits, Administrative Proceedings, and Legal Process

We may disclose health information in response to a valid court or administrative order. We may also disclose information in response to a subpoena, discovery request, or other lawful process when applicable legal requirements have been satisfied.

Substance-Use-Disorder Records Protected by 42 CFR Part 2

Some substance-use-disorder patient records may receive additional confidentiality protection under 42 U.S.C. 290dd-2 and 42 CFR Part 2.

To the extent that Welgen One maintains or receives substance-use-disorder patient records protected by Part 2, we will not use or disclose information from those records in a civil, criminal, administrative, or legislative investigation or proceeding against you unless:

  1. You provide specific written consent authorizing the use or disclosure; or
  2. The use or disclosure is authorized by a court order and accompanied by a subpoena or other legal mandate requiring disclosure.

A general authorization for the release of medical information may not be sufficient to authorize the use of Part 2 records in a legal investigation or proceeding against you.

Part 2 records may otherwise be used or disclosed for treatment, payment, and healthcare operations when permitted by applicable law and authorized through a legally valid consent or another applicable permission.

Welgen One’s inclusion of this section does not mean that Welgen One operates a federally assisted substance-use-disorder treatment program. These additional protections apply only when the information at issue qualifies as a Part 2 record.

Information Receiving Additional Protection

Certain categories of health information may receive additional protection under federal or state law. These categories may include substance-use-disorder records, psychotherapy notes, mental or behavioral health records, HIV/AIDS information, genetic information, and other specially protected information.

When a federal or state law provides greater privacy protection than HIPAA, Welgen One will follow the more protective law. We will obtain written authorization before using or disclosing specially protected information when authorization is required.

Our Responsibilities

  • We are required by law to maintain the privacy and security of your protected health information.
  • We must follow the duties and privacy practices described in the version of this notice currently in effect.
  • We must provide you with a copy of this notice upon request.
  • We will notify affected individuals following a breach of unsecured protected health information when notification is required by law.
  • We will not use or disclose your health information for purposes not described in this notice unless you provide written authorization or the law otherwise permits or requires the use or disclosure.
  • If you provide authorization, you may revoke it in writing at any time, except to the extent we have already acted in reliance on it.
  • We will not retaliate against you for exercising your privacy rights or filing a good-faith complaint.

Changes to This Notice

We may change the terms of this notice and apply the revised notice to all health information we maintain, including information created or received before the revision.

If we make a material change, the revised notice will be available upon request, at our healthcare locations, and on our website. The notice will display its effective date.
